Constitution
A student council constitution is a written document that sets forth the fundamental principles under which the council operates and is organized. The constitution deals with general purposes and outlines the ways the council is organized and is run. The constitution should be tailored to the particular group for which it is intended. However, the basic principles of a constitution are the same for all groups. Below is an outline of the fundamental provisions that should be addressed in all constitutions. (HINT- the constitution should be broad and general; save the specific details for the bylaws - see below)
All constitutions should:
- state the name of the organization
- outline the general purposes/goals of the organization
- detail the membership qualifications and election procedure
- outline general meeting structure
- outline adoption and amendment procedures
- state source of parliamentary authority and state who may veto proposals or actions of the organizations
Bylaws
Written bylaws are designed to supplement the constitution. The bylaws contain more specific information than the general constitution. Some student councils handle all details of their operations through their bylaws. Each council must determine how detailed and formal their bylaws should be. The bylaws should be reviewed often and updated as necessary.
Generally, the following items should be included in bylaws:
- description and responsibilities of officers
- officer/member installation procedures
- types and purposes of committees
- adoption and amendment procedure for bylaws
- procedures for filling vacancies and removal from office
Tips for Advisors
- locate and review your constitution
- if the only copy of your constitution was created on a typewriter - it's time to review and update the document
- If current practice in your council doesn't match what’s written in your constitution, either update the document or change your practice
- make sure your principal has a copy of your most updated constitution
- distribute a copy of your constitution to all students (officers and members) in your council
- distribute a copy to parents of your officers - this can help if you have to remove a student from office
- review sections of the constitution at each meeting
- the constitution is your friend - having a solid, updated document to refer to can help when problems arise with students, faculty and parents
